Client-centered mediation takes the emotional, financial and social distress of the divorce into consideration throughout the process. Mediation is the ideal solution to a legally compliant uncontested divorce.


ROLE OF THE MEDIATOR IN A DIVORCE AND HOW THE PROCESS WORKS

Compassionate Client-Centered Divorce Mediation

  • Assists divorcing clients in achieving a resolution that is acceptable to both through engaging in discussions focusing on the present and how to best plan for the future.
  • Examines their interests and explores various options for a settlement that addresses everyone's needs including those of their children.
  •  Facilitates and actively engages you in a series of discussions surrounding all the necessary issues to be resolved in the divorce (parenting plan, time sharing, child support, alimony, distribution of property, etc.).
  • Uses a variety of conflict resolution techniques to help you communicate, understand each other's interests, and negotiate when there are areas of disagreement.

The issues will vary in complexity based on your unique situation and may include, but are not limited to:

  • A parenting plan outlining parental responsibilities and time sharing arrangements for co-parenting your children post-divorce (custody arrangements).
  • Child support which is the financial support each parent will provide the children.
  • The division of marital assets and liabilities (also known as equitable distribution of community property.
  • If appropriate, how much, and for how long a client  will pay or receive alimony - also referred to as spousal support, which is determined not only by need, but also ability to pay.

Along with the four main issues listed above, a client-centered mediator can also help couples resolve a host of other important issues such as who will care for the family pet, etc.

How Long Does The Divorce Mediation Process Take?

 

Every mediator's process (if they have one) is different, so I can only speak to how long divorce mediation takes working with me. The  Most couples require 2 to 5 mediation sessions on average, the family mediation process takes 3-6 months from start to finish.

That time is spent gathering information and documents, negotiating the issues and the mediator uses what is mutually agreed upon in drafting the divorce agreement (which when filed with the court is referred to as the Consent Judgement of Divorce).
